Liability of a Fiduciary

Whether you just inherited a home as a successor trustee, or are a professional fiduciary, executor, or estate administrator, making good decisions requires a thoughtful plan, and partnering with a seasoned professional in Real Estate can help. First and foremost, it’s essential to understand the legal and financial responsibilities involved. When you are acting as a fiduciary, you have to have the goals of the estate in mind.  Often the proceeds will be part of a Trust distribution that can go to many different people. Your job is to make sure that they all feel that you did the best thing for the estate with all the decisions of selling the property. 

Strategies Based on Occupancy

Preparing a property for sale requires different strategies based on who lives there. Whether the property is vacant, tenant-occupied, owner-occupied, or has limited access, we tailor our approach to maximize exposure and convenience for potential buyers.

Selling a vacant home offers flexibility for showings, easier presentation as you can stage the property, and availability for hosting open houses and private showings as needed. Often vacant homes can easily allow a secure lockbox and well placed For Sale sign to attract more buyers. 

For tenant-occupied homes, coordinating with tenants to minimize disruptions is essential. Schedule limited group showings and private viewings during agreed-upon times. Providing tenants with my contact so that I can help them understand the process as well.  

Homes with strict HOA rules or uncooperative occupants require private showings by appointment only. Avoid open houses and focus on serious, pre-qualified buyers. Limited group showings or showings only with an accepted offer may be necessary.

On rare occasions, gaining access to the property may not be possible due to uncooperative occupants.  We can discuss options for assisting with eviction, or, selling the home with the occupants in it for the next owner to manage.

Preparing the Property For Sale - Utilizing our Resources

Many attorneys have advised to sell a property in a probate or trust "as is".  This is for the reasons of minimizing liability of the fiduciary as they aren't making construction decisions on behalf of an estate asset that could be questioned.  Also, the trustee can get the home on the market much quicker when the home is sold "as is".  

Just because a home is sold without updates or repairs, doesn't mean you must put it on the market in disrepair.  My team works with the Client to assess a plan often with an estate sale to clean out the house, organize donating items that cannot be sold, painting, cleaning and any other repairs to get the most money for the home without breaking the bank.
